1 SCOPE OF APPLICATION

The following General Terms and Conditions (GTC) apply to all orders placed via our online shop at witchlandia.de.

2 CONTRACTING PARTNER

The purchase contract is concluded with Christina Weidmann (sole proprietor) / Witchlandia. The company's registered office is Bismarckstr. 15 in 50672 Cologne. Further information can be found in the imprint.

3 CONCLUSION OF CONTRACT

The contract can only be concluded in German. The presentation of our products in the online shop does not constitute a legally binding offer, but a non-binding online product catalog. You can select products from the assortment presented in the online shop and collect them in the "shopping cart" by clicking the "Add to cart" button. On the category pages, which present several products to you as an overview, our "Quick Buy" option is usually also available to you: If you move the mouse pointer over a product image, a "Quick Buy" button appears. By clicking this button, a window opens in which you can directly add the product to the shopping cart by clicking the shopping cart symbol within it. In the upper right next to the navigation, you will find the shopping cart, which is represented by a symbol (shopping cart) or by the word "Shopping Cart" (depending on the device you are using to visit our site). By clicking on the symbol or the text "Shopping Cart", you can access your shopping cart and make changes at any time, for example, remove selected products from the shopping cart. By clicking the "Checkout" button, you have the option to log in with your customer account or proceed as a guest, or log in to the payment service provider PayPal. You will then be taken to the order overview. Here you can enter your personal data and select the payment and shipping conditions. As long as you do not click the "Buy Now" button, you can edit and, if necessary, correct your entries, in particular the details of your order, or cancel the purchase. If you use a payment service provider such as PayPal as a payment method, you will first be redirected to the external website of the payment service provider. On this page, you first enter your data. Finally, you will be redirected back to the online shop to the page with the order overview. As long as you do not click the "Buy Now" button, you have the option to edit, correct your entries (in particular the details of your order) or cancel the purchase. By clicking the "Buy Now" button, you submit a legally binding offer to us to conclude a contract. Immediately after submitting the order, we will send you an order confirmation by email. The order confirmation lists the details of your order again. However, the order confirmation does not yet constitute an acceptance of your offer. We can accept your order by sending an order confirmation by email or by delivering the goods within 5 working days. The contract text of these GTC is not stored by us. You can access the current version of the GTC in our online shop. In addition, you have the option to access our GTC before placing your binding order and print them out via your browser or save them electronically.

4 PRICES AND SHIPPING COSTS

The prices on our website are stated inclusive of statutory VAT. Shipping costs may be added to the sales prices. Delivery to Germany and Austria is free of shipping costs. For delivery to France, Sweden, Denmark and Italy, we charge €8.90. For deliveries to non-EU countries, additional customs duties, taxes and fees usually apply. Self-collection of goods is not possible.

If a package cannot be delivered due to missing or incorrect address details, we reserve the right, in exceptional cases, to charge the DHL return flat rate, provided that the incorrect information was caused by the customer. If acceptance of a package is refused by the recipient, the costs of the DHL return flat rate will generally be deducted from the refund. Excluded from this regulation is a refusal of acceptance due to a severely damaged package: In this case, we will check the return for transport damage and provide a replacement or a full refund.

5 DELIVERY TIME

The delivery time for orders within Germany is 1 to 3 working days. Orders to other European countries will be delivered within 3 to 7 days.

6 PAYMENT

Payment for orders on witchlandia.de is made via PayPal or credit card, Klarna, Apple Pay, Giropay, or instant bank transfer. When paying with PayPal, you will be redirected to PayPal after confirming the purchase, where you will be prompted to pay. Only then will the purchase be concluded. When paying by credit card, your credit card account will be charged upon completion of the order.

7 WARRANTY

We are liable for material defects and defects of title in accordance with the applicable statutory provisions, in particular §§ 434 et seq. BGB (German Civil Code). The warranty period for goods delivered by us to entrepreneurs is one year after delivery.

8 RIGHT OF WITHDRAWAL

You have the right to withdraw from this contract within one month without giving any reason. The withdrawal period is one month from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods. To exercise your right of withdrawal, you must inform us (Witchlandia / Christina Weidmann, Bismarckstr. 15, 50672 Cologne, tina@witchlandia.de) by means of a clear statement (e.g. email or a letter sent by post) of your decision to withdraw from this contract. You can use the attached sample withdrawal form for this purpose, but it is not mandatory. To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period. Consequences of withdrawal: If you withdraw from this contract, we must repay to you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from your choosing a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days from the day on which the notification of your withdrawal from this contract has reached us. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged fees for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. In the event of a withdrawal within 30 days, you bear the costs of returning the goods. For your first order, within 30 days of receiving the goods, we also offer free returns in addition to the right of withdrawal. In addition to the free first return, you can use our return service and order a discounted return label for €4, which will be offset against your refund accordingly.

10 SEVERABILITY CLAUSE

In the event that individual provisions of the GTC listed here are or become ineffective, or should the GTC have an unforeseen gap, the effectiveness of the remaining provisions or parts of such provisions shall remain unaffected. This does not apply if the omission of individual clauses would disadvantage a contracting party to such an unreasonable extent that a continuation of the contract can no longer be expected.
